Terms of use — BudGénie

This is an English translation provided for convenience. The French version of these terms is the legally binding one; in case of discrepancy, the French text prevails.

Distribution of the app: Apple Inc., via the Mac App Store. BudGénie is not hosted on a server of ours: it is downloaded from Apple's servers and runs on your Mac.

2. Purpose, and who sells you the app

BudGénie is a macOS app for managing your budget, net worth, investments and rental property. Using the app means accepting these terms.

The sales contract is not made with us. On the Mac App Store, Apple is the seller: Apple takes the payment, issues the invoice, applies the buyer's local VAT and handles refunds. Apple's terms of sale therefore govern the purchase.

This document governs what is our responsibility: the right to use the software, what it does, what it does not do, and our respective responsibilities. This is what Apple calls the EULA — the licence agreement.

These terms apply to distribution through the Mac App Store. If BudGénie were ever sold directly from budgenie.eu, the publisher would become the seller, and separate terms of sale would apply.

3. Editions and purchase

One free edition, two subscription editions

The Free edition is free, with no time limit and no bank card required. Essential and Premium are subscriptions, renewed automatically and cancellable at any time: yearly, and Premium is also available monthly.

The editions

Import and export of your data are available in every edition, Free included.

Prices include VAT, in euros, and are given for information: the prices shown on the Mac App Store at the time of purchase prevail, including the buyer's local VAT.

A Pro edition is planned, which will add rental property, built-in and automatic artificial intelligence analysis, and bank aggregation. It is not on sale at this time: until it is, it cannot be bought, and these terms will be supplemented before it opens — in particular regarding the processing of bank data, which will change the nature of the privacy policy.

Renewal, cancellation, price changes

The subscription renews automatically for the same period (one year, or one month for the monthly plan) unless cancelled at least 24 hours before the renewal date. The amount is charged within the 24 hours before the new period begins.

Cancellation is done in your Apple account settings, at any time and without giving a reason. It takes effect at the end of the period already paid for: access stays open until then.

A price increase never applies without the subscriber being informed by Apple and, depending on the case, without their express consent. Without consent, the subscription ends at the renewal date rather than renewing at the new price.

Moving from one edition to another

The editions belong to a single subscription group. Moving to a higher edition takes effect immediately, and Apple prorates the time already paid for. Moving to a lower edition takes effect at the next renewal date.

What happens to your data if the subscription stops

Nothing is deleted. Your data stays on your Mac, intact, and becomes fully usable again as soon as a subscription is resumed. Screens the Free edition does not cover are no longer accessible, and the items they contained are no longer counted in the totals shown — but they are neither erased nor changed. You can export all your data at any time from the Free edition.

Getting your subscription back

After a reinstall or on another Mac, the "Restore my purchases" button (Settings → About) restores your edition from your Apple account. A current subscription applies to every Mac using that account.

If a payment fails

Apple allows a grace period before stopping a subscription whose payment has failed. During that period, access remains complete; the app points this out so that the situation can be sorted out.

Refunds

Payments are collected by Apple. Refund requests are made to Apple (reportproblem.apple.com), under its terms. We have no say in those decisions.

Legal guarantee of conformity for digital content

BudGénie is digital content within the meaning of articles L.224-25-1 et seq. of the French Consumer Code. As such:

• consumers benefit from a two-year legal guarantee of conformity from the supply of the digital content;
• during that period, any lack of conformity that appears is presumed to have existed at the time of supply;
• bringing the content into conformity is done free of charge for the consumer;
• if that is impossible or does not happen within a reasonable time, the consumer can obtain a price reduction or termination of the contract;
• we undertake to provide the updates needed to keep the app in conformity during that period, in accordance with article L.224-25-25 of the same code.

Consumers also benefit from the legal guarantee against hidden defects under articles 1641 et seq. of the French Civil Code.

These guarantees apply independently of Apple's commercial policy and of these terms. No clause in this document can exclude them.

What the free edition does

The Free edition is not a time-limited trial: it never expires. It is limited in scope — one account, the current month — not in time.

It contains no advertising. No ad network is built into BudGénie, in any edition. An app that shows your bank accounts has no business being an ad display.

Your data does not depend on what you paid

Your data stays intact and accessible, whatever your edition. Features from a higher edition are unavailable, but nothing is deleted and the full export is still available.

We believe an app that holds your data hostage does not deserve to be paid for.

4. What BudGénie is not

BudGénie is not a financial adviser.

The calculations, projections, loan simulations, portfolio analyses, financial independence calculations and artificial intelligence analyses are tools for calculation and reflection. They are neither personalised investment advice, nor recommendations to buy or sell, nor tax or legal advice.

The financial decisions you make are yours alone. For personal advice, consult an authorised professional (financial investment adviser, chartered accountant, notary).

The prices shown come from third-party public sources. They may be delayed, incomplete or wrong. Never make a decision to buy or sell based solely on a figure shown here: check with your broker.

5. Your data belongs to you

Your data stays on your Mac (see the Privacy policy, in Settings → About).

You are responsible for your backups. The app offers a full export; we hold no copy and cannot restore anything. In the event of a breakdown, theft or deletion, only your own backups protect you.

6. Use

You agree not to:

• decompile, disassemble or modify the app, except within the limits allowed by law;
• redistribute, resell or rent it;
• get around the limits of the editions;
• use it for any unlawful activity.

7. Intellectual property

The app, its code, its name, its visual identity and its documentation are protected. Your content — your financial data — remains entirely your property; no licence to it is granted to us.

8. Liability

The app is provided "as is". We do everything we can to make it reliable and accurate, but we do not guarantee that it is entirely free of defects, nor the accuracy of financial data from third-party sources.

We cannot be held liable for financial decisions made on the basis of the information displayed, nor for data loss resulting from a lack of backup on your part.

These limitations apply within the limits allowed by French law and do not restrict consumers' mandatory rights, nor our liability in the event of gross negligence or wilful misconduct.

9. Changes

These terms may change. Any substantial change will be announced in the app, and will take effect with the following update.

A change to the terms does not apply to the period already paid for. If you are unhappy with a substantial change, you can cancel from your Apple account settings: your edition stays active until the end of the current period, and your data remains yours, exportable at any time (section 5).

10. Governing law and disputes

These terms are governed by French law.

Complaints

First write to us at support@budgenie.eu. Most disputes are settled this way, and this step is a prerequisite for mediation: the mediator can only be approached after a written complaint that has gone unanswered for two months, or whose answer did not satisfy you, and within one year of that complaint.

Consumer mediation

In accordance with article L.612-1 of the French Consumer Code, every consumer has the right to use a consumer mediator free of charge to settle a dispute amicably, after first trying to settle it directly with us through a written complaint.

A consumer mediator listed by the French Commission for the evaluation and control of consumer mediation (CECMC). Referral is made in writing, in French, online or by post, with a description of the dispute and a copy of your prior complaint. Mediation is free for you; its costs are borne by us. It lasts no more than ninety days, you can withdraw at any time, and the proposed solution is binding on no one: everyone remains free to accept it or to go to court.

What has disappeared

The European online dispute resolution platform (ODR) was permanently closed on 20 July 2025, under Regulation (EU) 2024/3228 of 19 December 2024 repealing Regulation (EU) No 524/2013. It is therefore no longer mentioned here, and any document that still refers to it directs consumers to a service that no longer exists.

Jurisdiction

Failing an amicable settlement, the French courts have jurisdiction. The consumer may bring proceedings before the court of the place where they lived when the contract was concluded, the court of the place where the harm occurred, or the court of the defendant's domicile (article R.631-3 of the French Consumer Code).
